HOW IT WORKS
1 Register your spotSign up as an individual - no team needed. However, you can also specify to be added to a team with any preferred teammates. All skill levels welcome, from beginners to experienced players.2 Get assigned a teamWe'll contact you in the week before Round 1 with your team and jersey colour. You'll be added to a group chat with your other team members.3 Show up, play and eat!Games run for 10 weeks every Sunday evening (approx. 5-7pm) at Cintra Park, Concord. Bring a water bottle, flat-bottom running shoes (NO BOOTS WITH STUDS ALLOWED) and wear a shirt in the colour your team decides! Optional dinner after at Lilly's Espresso & Cucina, Rhodes.

Security, Access and correction(a) We store your Personal Information in a way that reasonably protects it from unauthorised access, misuse, modification or disclosure. When we no longer require your Personal Information for the purpose for which we obtained in, we will take reasonable steps to destroy and anonymise or de-identify it. Most of the Personal Information that is stored in our client files and records will be kept for a maximum of 7 years to fulfill our record keeping obligations.(b) The Australian Privacy Principles:(i) permit you to obtain access to the Personal Information we hold about you in certain circumstances (Australian Privacy Principle 12); and(ii) allow you to correct inaccurate Personal Information subject to certain exceptions (Australian Privacy Principle 13).(c) Where you would like to obtain such access, please contact us in writing on the contact details set out at the bottom of this privacy policy.6. Access to and use of the Website, or any of its associated Products or Services, is provided by FOOTBALL FIVES PTY LTD. Please read these terms and conditions (Terms) carefully. By using, browsing and/or reading the Website, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Website, or any of Services, immediately.(c) FOOTBALL FIVES PTY LTD reserves the right to review and change any of the Terms by updating this page at its sole discretion. Appropriate legal action will be taken by FOOTBALL FIVES PTY LTD for any illegal or unauthorised use of the Website; and(viii) you acknowledge and agree that any automated use of the Website or its Services is prohibited.4. Participants under 18 years of ageIf you are under 18 years of age, you must have your parent or legal guardian's consent before:(a) registering for the Services;(b) participating in any FOOTBALL FIVES PTY LTD competition or activity; and(c) providing any personal information to FOOTBALL FIVES PTY LTD.By accepting these Terms, your parent or legal guardian:(a) acknowledges they have read and understood these Terms;(b) consents to you participating in FOOTBALL FIVES PTY LTD competitions and activities;(c) accepts responsibility for your compliance with these Terms; and(d) agrees to be bound by these Terms in respect of your participation.FOOTBALL FIVES PTY LTD reserves the right to request proof of parental or guardian consent at any time and may suspend or terminate your participation if such proof is not provided within a reasonable timeframe.5. Payment(a) All payments made in the course of your use of the Services are made using Stripe. In using the Website, the Services or when making any payment in relation to your use of the Services, you warrant that you have read, understood and agree to be bound by the Stripe terms and conditions which are available on their website.(b) You acknowledge and agree that where a request for the payment of the registration is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the registration.(c) You agree and acknowledge that FOOTBALL FIVES PTY LTD can vary the prices for their seasonable competitions at any time, with at least 14 days notice on the website prior to the commencement of the next competition.(d) You acknowledge and agree that FOOTBALL FIVES PTY LTD may, at its sole discretion and without prior notice, suspend or terminate your access to the Website and Services if you breach these Terms or engage in any conduct that FOOTBALL FIVES PTY LTD believes, in its sole discretion, violates any applicable law or is harmful to the interests of FOOTBALL FIVES PTY LTD, its affiliates, or any third party.6. Refund Policy(a) FOOTBALL FIVES PTY LTD will only provide you with a refund of the Services in the event they are unable to continue to provide the Services or if the manager of FOOTBALL FIVES PTY LTD makes a decision, at its absolute discretion, that it is reasonable to do so under the circumstances (Refund).(b) Any benefits set out in this Terms and Conditions may apply in addition to consumer's rights under the Australian Consumer Law.7. (a) FOOTBALL FIVES PTY LTD's total liability arising out of or in connection with the Services or these Terms, however arising, including under contract, tort (including negligence), in equity, under statute or otherwise, will not exceed the resupply of the Services to you. This section should be read in accordance with the 'Liability Waiver and Release' provided by FOOTBALL FIVES PTY LTD at section 10 below.(b) You expressly understand and agree that FOOTBALL FIVES PTY LTD, its affiliates, employees, agents, contributors and licensors shall not be liable to you for any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by you, however caused and under any theory of liability. This shall include, but is not limited to, any loss of profit (whether incurred directly or indirectly), any loss of goodwill or business reputation and any other intangible loss.11. Liability Waiver and Release(a) This waiver is provided in accordance with s 139A of the Competition and Consumer Act 2010 (Cth) which permits the exclusion of liability for recreational services.(b) Under the Australian Consumer Law, the supplier of recreational services is entitled to exclude liability. By signing this waiver, I acknowledge and accept that exclusion.(c) As a participant of FOOTBALL FIVES PTY LTD PTY LTD, I hereby waive and release, indemnify, hold harmless and forever discharge FOOTBALL FIVES PTY LTD, and its agents, employees, officers, directors, affiliates, successors and assigns, coaches, teachers and trustees of and from any and all claims, demands, debts, contracts, expenses, cause of action, lawsuits, damages, and liabilities, of every kind of nature, whether known or unknown, in law or equity, that I ever had or may have, arising from or in any way related to my participation in any of the events or activities conducted by, on the premises, of, or for the benefit of, FOOTBALL FIVES PTY LTD, provided that this waive of liability does not apply to any acts of gross negligence, or intentional, wilful or wanton misconduct.(d) I acknowledge that it is my responsibility to notify FOOTBALL FIVES PTY LTD of any medical condition, injury or illness that may affect my participation in the activities provided by FOOTBALL FIVES PTY LTD. FOOTBALL FIVES PTY LTD does not require the disclosure of medical information, but participants are encouraged to advise of any relevant conditions for safety purposes.
(e) In the event of a medical emergency, I authorise FOOTBALL FIVES PTY LTD to arrange medical assistance including an ambulance, and I agree to be responsible for any associated costs.(f) I understand that the activities, in which I will participate, are inherently dangerous and may cause serious or grievous injuries, including bodily injury, damage to personal property and/or death. On behalf of myself, my heirs, assigns, administrators, executors and next of kin, I waive all claims of damage, injuries and death sustained to me or my property, that I may have against the aforementioned release party to such activities, including claims in tort, contract, equity or otherwise.(g) I acknowledge, agree and represent that I understand the nature of the activities provided at FOOTBALL FIVES PTY LTD, I am in good health and in proper physical condition to participate in such activities. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the activity.(h) By this Waiver, I assume any risk, and take full responsibility and waive any liability for personal injury, death, damage, or loss of personal property, associated with FOOTBALL FIVES PTY LTD, including but not limited to injury incurred to persons or property during football games, following the termination of participation in the activities provided by FOOTBALL FIVES PTY LTD.(i) This waiver and release supersedes any prior written or oral agreements between them concerning the subject matter of this waiver and release. The provisions of this waiver and release may be waived, altered, amended or repealed, in whole or in part, only upon the prior written consent of all parties.(j) The provision of this waiver and release will continue in full force and effect even after the termination of the activities conducted by, on the premises of, or for the benefit of FOOTBALL FIVES PTY LTD, whether by agreement, by operation of law, or otherwise.(k) I have read, understood and fully agree to the term of this waiver and release. I understand and confirm that by signing this waiver and release I have given up considerable future legal rights. I have signed this agreement freely, voluntarily, under no duress or threat of duress, without inducement, promise or guarantee being communicated me. My signature is proof of my intention to execute a complete and unconditional waiver and release of all liability to the full extent of the law.12. CompetitorsIf you are in the business of providing similar Services for the purpose of providing them to users for a commercial gain, whether business users or domestic users, then you are a competitor of FOOTBALL FIVES PTY LTD. Competitors are not permitted to use or access any information or content on our Application. If you breach this provision, FOOTBALL FIVES PTY LTD will hold you fully responsible for any loss that we may sustain and hold you accountable for all profits that you might make from such a breach.13. Termination of Contract
(a) The Terms will continue to apply until terminated by either you or by FOOTBALL FIVES PTY LTD as set out below.(b) If you want to terminate the Terms, you may do so by:(i) providing FOOTBALL FIVES PTY LTD with 30 days' notice of your intention to terminate; and(ii) closing your accounts for all of the services which you use, where FOOTBALL FIVES PTY LTD has made this option available to you.Your notice should be sent, in writing, to FOOTBALL FIVES PTY LTD via the contact details on our website.(c) FOOTBALL FIVES PTY LTD may at any time, terminate the Terms with you if:(i) you have breached any provision of the Terms or intend to breach any provision;(ii) FOOTBALL FIVES PTY LTD is required to do so by law;(iii) the provision of the Services to you by FOOTBALL FIVES PTY LTD is, in the opinion of FOOTBALL FIVES PTY LTD, no longer commercially viable.(d) Subject to local applicable laws, FOOTBALL FIVES PTY LTD reserves the right to discontinue or cancel your registration at any time and may suspend or deny, in its sole discretion, your access to all or any portion of the Website or the Services without notice if you breach any provision of the Terms or any applicable law or if your conduct impacts FOOTBALL FIVES PTY LTD's name or reputation or violates the rights of those of another party.14. IndemnityYou agree to indemnify FOOTBALL FIVES PTY LTD, its affiliates, employees, agents, contributors, third party content providers and licensors from and against:(a) all actions, suits, claims, demands, liabilities, costs, expenses, loss and damage (including legal fees on a full indemnity basis) incurred, suffered or arising out of or in connection with your content;(b) any direct or indirect consequences of you accessing, using or transacting on the Website or attempts to do so; and/or(c) any breach of the Terms.15. Dispute Resolution
(a) Compulsory:
If a dispute arises out of or relates to the Terms, either party may not commence any Tribunal or Court proceedings in relation to the dispute, unless the following clauses have been complied with (except where urgent interlocutory relief is sought).(b) Notice:A party to the Terms claiming a dispute (Dispute) has arisen under the Terms, must give written notice to the other party detailing the nature of the dispute, the desired outcome and the action required to settle the Dispute.(c) Resolution:
On receipt of that notice (Notice) by that other party, the parties to the Terms (Parties) must:(i) Within 28 days of the Notice endeavour in good faith to resolve the Dispute expeditiously by negotiation or such other means upon which they may mutually agree;(ii) If for any reason whatsoever, 28 days after the date of the Notice, the Dispute has not been resolved, the Parties must either agree upon selection of a mediator or request that an appropriate mediator be appointed by the ;(iii) The Parties are equally liable for the fees and reasonable expenses of a mediator and the cost of the venue of the mediation and without limiting the foregoing undertake to pay any amounts requested by the mediator as a precondition to the mediation commencing. The Parties must each pay their own costs associated with the mediation;(iv) The mediation will be held in Sydney, Australia.(d) Confidential
All communications concerning negotiations made by the Parties arising out of and in connection with this dispute resolution clause are confidential and to the extent possible, must be treated as "without prejudice" negotiations for the purpose of applicable laws of evidence.(e) Termination of Mediation:
If 2 months have elapsed after the start of a mediation of the Dispute and the Dispute has not been resolved, either Party may ask the mediator to terminate the mediation and the mediator must do so.16. Venue and JurisdictionThe Services offered by FOOTBALL FIVES PTY LTD is intended to be viewed by residents of Australia. In the event of any dispute arising out of or in relation to the Website, you agree that the exclusive venue for resolving any dispute shall be in the courts of New South Wales, Australia.17. Governing LawThe Terms are governed by the laws of New South Wales, Australia. Any dispute, controversy, proceeding or claim of whatever nature arising out of or in any way relating to the Terms and the rights created hereby shall be governed, interpreted and construed by, under and pursuant to the laws of New South Wales, Australia, without reference to conflict of law principles, notwithstanding mandatory rules. The validity of this governing law clause is not contested. The Terms shall be binding to the benefit of the parties hereto and their successors and assigns.18. SeveranceIf any part of these Terms is found to be void or unenforceable by a Court of competent jurisdiction, that part shall be severed and the rest of the Terms shall remain in force.19. Photography and Media Rights(a) By participating in FOOTBALL FIVES PTY LTD competitions and activities, you acknowledge and agree that:(i) FOOTBALL FIVES PTY LTD may photograph, film, or record you during competitions, games, and related events;(ii) any such photographs, videos, or recordings may include your image, likeness, voice, and performance;(iii) FOOTBALL FIVES PTY LTD owns all rights to these materials and may use them for any lawful purpose, including but not limited to marketing, advertising, promotion, social media, websites, and other commercial purposes; and(iv) such use may occur without further notice or compensation to you.(b) If you are under 18 years of age, your parent or legal guardian's acceptance of these Terms includes consent to the photography and media rights outlined above.(c) If you have a legitimate reason for not wanting to be photographed or filmed, you must notify FOOTBALL FIVES PTY LTD in writing before participating in any competition or activity.(d) FOOTBALL FIVES PTY LTD will make reasonable efforts to respect individual privacy and ensure that any media content is used in an appropriate and respectful manner.20. Competition RulesAll participants must adhere to the following rules when participating in FOOTBALL FIVES PTY LTD competitions:(a) Game Basics● Each team consists of 5 players on the field with up to 5 substitutes● A minimum of ONE female player must be on the field at all times● One player on the field must be a goalkeeper● Games consist of 2 x 18-minute halves with a 2-minute half-time break● Teams must arrive at least 20 minutes before the kick-off time● A minimum of 3 players is required for a team to start a match● Play will resume through kick-ins (no throw-ins)● Goalkeepers are not allowed to drop-kick the ball● Slide tackling is not allowed(b) Scoring and Competition Points● Win = 3 points● Draw = 1 point● Loss = 0 points● Forfeit = 3-0 loss recorded against forfeiting team(c) Equipment Requirements● Teams must wear matching coloured shirts● Bibs will be provided if a clash of team coloured shirts occurs● All players are strongly advised to wear shin guards● Only sneakers or futsal boots can be worn on the playing surface● The competition organiser will provide the match ball(d) Competition-Specific Regulations● All players must register and pay before the first game of the competition● Players must have played at least 3 regular season games to qualify for finals● A fill-in player may play for no more than 2 games● If a fill-in player wishes to play more than 2 games, they must become a registered player● No fill-in player is allowed to play in the finals● A team may have no more than 3 separate fill-in players throughout the competition● In case of a tie in finals, 5 minutes of golden goal followed by penalty shootout will apply● The competition organisers' decision on all matters is final(e) Gameplay Rules● No offside rule applies● All free kicks are direct● Opponents must be at least 2 metres from the ball for free kicks● Sliding tackles are not permitted● Goalkeepers cannot throw the ball over the halfway line on the full(f) Substitutions● Rolling substitutions are allowed at any time during the game● Substitutions must be made at the halfway line● The outgoing player must leave the field before the substitute enters(g) Fouls and Misconduct● Yellow cards and red cards are applicable in all fixtures● Two yellow cards received within one match result in a red card being awarded● Red card results in player ejection and minimum one-game suspension● Serious misconduct may result in longer suspension or competition expulsion at the competition organiser's discretionFOOTBALL FIVES PTY LTD reserves the right to amend these rules at any time. Any changes will be communicated to all registered teams with reasonable notice.21. Code of ConductAs a participant in the FOOTBALL FIVES PTY LTD competition, you agree to adhere to the following code of conduct:(a) Display good sportsmanship at all times, treating other players, officials, and staff with respect regardless of ability, gender, race, religion, or cultural background;(b) Comply with the rules of the game and accept the decisions of match officials without dissent;(c) Refrain from violent, aggressive, or abusive behavior, including the use of offensive language or gestures;(d) Play in a manner that ensures the safety of yourself and others, avoiding dangerous or reckless actions;(e) Respect and properly use all facilities and equipment provided;(f) Not participate while under the influence of alcohol or prohibited substances;(g) Acknowledge that breaches of this Code of Conduct may result in penalties, including but not limited to warnings, suspension, or permanent exclusion from the competition, as determined by FOOTBALL FIVES PTY LTD in its sole discretion.
